The hailthekale.com.au website is owned and operated by Hail the Kale PTY LTD. (ABN:20 192 824 265). By accessing, browsing or using this website, you agree to the terms, conditions and disclaimers herein as amended from time to time.

By purchasing an item advertised on this website and/or becoming a member of Hail the Kale, you agree to these Terms and Conditions. hailthekale.com.au may amend these Terms and Conditions from time to time and any amendment will become effective immediately. Your continued use of this website after amendment constitutes an agreement to abide by and be bound by those amended Terms and Conditions.

All material on this site, including, but not limited to images, logos and illustrations, is protected by copyrights, trademarks, and other intellectual property rights which are owned and controlled by hailthekale.com.au and its related companies. The content of hailthekale.com.au is provided for your personal, non-commercial use. Such material may not be copied, republished, reproduced, uploaded, modified, transmitted, posted, or distributed in any way without the consent of hailthekale.com.au

The use of this website and these conditions is in accordance with the laws of Australia. Any legal action arising out of its use shall be brought and enforced under Australian laws. By using this site, you agree to submit to the jurisdiction of the courts of Australia and any legal action pursued by you shall be within the exclusive jurisdiction of the courts of Australia


Orders are delivered between 7 am - 3 pm on the day of delivery. Please give as much info as possible regarding drop-off notes so our delivery driver can easily find you. We currently do not provide cooling but we are working on a solution to provide this. If you are not home to receive your delivery we advise you to have it delivered to your work place or to have someone there to receive on arrival. 

You will receive tracking information the day before delivery. If no one is home at the time your order is delivered and we do not have permission to leave your order by the door you will be notified and your order will be bought back to our factory for collection at a later time. 

Hail the Kale recommends you use a business address if there is a chance you may not be home. Hail the Kale requests that the recipient be available to receive the delivery on the day of delivery. If no one is available to accept the delivery, then the bag will be left outside the residence and Hail the Kale takes no responsibility for it after this time.

Unattended Deliveries
Hail the Kale will deliver your bowls to you in the timeframe specified. It is important the customer provides clear and accurate delivery instructions when placing their order. Due to unforeseen circumstances, including traffic delays, we may have to deliver outside this time. Hail the kale will try to notify the customer if this is the case.

We will deliver to the address supplied at the time of checkout. If you are not home at the time of delivery our driver will call, and leave the order at your residence or workplace. Hail the Kale accepts no liability for products damaged, stolen or broken after they have been accepted by the customer. We also accept no liability or damages for personal harm or sickness that occurs as a result of consuming the product that have not been stored correctly as per our use by date and cooling instructions. 

Hail the Kale retains records for proof of delivery and remains exempt from any liability or responsibility for loss or damage arising as a result of our products being left safely and securely at unattended premises.  It clearly communicates that someone must accept delivery, or cooling can be provided by the customer if they wish. 

Shipping rates apply to postcodes within a 30km radius from our kitchen in East Victoria Park. These are subject to change at any time depending on the service that is provided. If you select the wrong delivery postcode we reserve the right to cancel and refund the amount. 

Cancellation Policy

Orders can be cancelled prior to 24 hours prior to the scheduled delivery date. Orders that are already prepared, dispatched or in transit cannot be cancelled or refunded. Cancellation of order incurs a $40.00 administrative fee. Money will be refunded less this fee. If cancellation notice is received at less than 24 hour notice - cancellation is void. A cancellation notice must be placed in email to [email protected]


Hail the Kale only uses the freshness produce that is direct from local farmers. From time to time we may swap something due to its seasonal quality but we will more than likely let the customer know if this is the case.
